These Terms of Use ("Terms") govern your access to and use of the Tide Alert mobile application ("App") developed and operated by Rivolu LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
By using the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Tide Alert provides tide predictions, tide charts, weather data, and related information for informational purposes only. The App displays tide data sourced from NOAA (United States), the UK Hydrographic Office (United Kingdom), and the Bureau of Meteorology (Australia), as well as weather data from Open-Meteo.
We may offer a free trial period for new users. During the free trial, you will have access to all premium features. At the end of the free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
Tide Alert offers auto-renewing subscription plans. The subscription grants access to all premium features including tide alerts, detailed charts, weather data, swell forecasts, widgets, and unlimited station access.
Payment will be charged to your Google Play account or Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
You can manage or cancel your subscription at any time through your device's app store settings (Google Play Store or Apple App Store). Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial billing periods.
We reserve the right to change subscription prices. Any price change will take effect at the start of the next subscription period following the date of the price change. Your continued use of the App after the price change constitutes your agreement to pay the updated amount.
Tide data displayed in the App is based on predictions and forecasts from third-party sources. This data is provided "as is" without warranty of any kind. Tide predictions do not account for the effects of wind, storms, rain, freshwater runoff, floods, or other meteorological events. The tide graph uses predicted high and low tide events, and segments between these events are approximated.
Do NOT use Tide Alert for navigation purposes or any other purpose that may result in personal injury or property damage.
To the maximum extent permitted by applicable law, Rivolu LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
In no event shall our aggregate liability exceed the amount you have paid us in the twelve (12) months prior to the event giving rise to the claim.
The App and its original content, features, and functionality are owned by Rivolu LLC and are protected by international copyright, trademark, and other intellectual property laws. Tide data is provided by their respective government agencies and is subject to their terms and conditions.

The App may contain links to or integrate with third-party services that are not owned or controlled by Rivolu LLC. We assume no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such third-party services.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the App after any changes to these Terms constitutes acceptance of those changes.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.
The App includes a Disclaimer regarding the accuracy and limitations of tide data provided by third-party sources including NOAA, the UK Hydrographic Office, and the Bureau of Meteorology. By using the App, you acknowledge and accept the terms of the Disclaimer.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
